The premium is set by the state, not the company
The basic premium for a title policy in Texas is fixed by the State, not by the title company you choose. Commissioner of Insurance Cassie Brown set the current rates in Official Order No. 2025-9697 on 19 December 2025, and ordered that companies and agents must use them from 1 March 2026.
The published formula
For a policy between $100,001 and $1,000,000, Exhibit A to that order sets out the arithmetic:
- Subtract $100,000 from the policy amount
- Multiply the result by 0.00494
- Round to the nearest dollar
- Add $780
Worked through, a $400,000 owner's policy comes to $2,262. A $600,000 owner's policy comes to $3,250. Every title company in Texas works from that same table.
Rates came down in 2026
That order cut basic premium rates by 6.2 percent, following a hearing under Texas Insurance Code Section 2703.202(c). The Texas Department of Insurance adopted the updated manual into rule at 28 TAC Section 9.1, effective 7 May 2026.
What the premium includes
Rate Rule R-1 states that the basic premium rates include the charge for title insurance, title examination, and closing the transaction.
Where a lender's policy is issued simultaneously with the owner's policy, Rate Rule R-5.A sets the premium for each loan policy at $100.00, where that rule's conditions are met.
What this means if you are relocating to DFW
If you are comparing closing cost estimates between providers, the title premium is not the variable. It is the same number everywhere. What differs is service: how cleanly the file closes, how quickly a figure reaches your lender, and whether anyone answers the phone in the evening when something needs deciding.
Ask about those instead.
This article describes process and cites published Texas rate orders. It is not legal or tax advice. Your title company and the policy itself govern your file.
